Hereinafter referred to as the “Seller.”
1.2. Buyer
The individual or legal entity purchasing products through leoncymbals.com.
The Buyer's name, contact information, billing details and delivery address are recorded during checkout and form part of the relevant order.
Hereinafter referred to as the “Buyer.”
2. PURPOSE AND SCOPE
This Agreement governs the distance sale of products offered through leoncymbals.com, including ordering, payment, production, delivery, withdrawal, returns and after-sales support.
Leon Cymbals is a brand specializing in handcrafted cymbals and related musical instruments and accessories.
The website primarily serves international customers.
Customers purchasing within Türkiye are directed to the Seller's domestic sales channels operated under Kıvılcım Müzik.
Nothing in this Agreement excludes or limits consumer rights that cannot lawfully be excluded or limited under applicable legislation.
3. PRODUCTS AND ORDER INFORMATION
The essential characteristics of each product are provided on its respective product page.
The order confirmation identifies the purchased products, quantities, prices, delivery information and any agreed customization requirements.
Leon Cymbals products are handcrafted. Natural variations in hammering patterns, surface texture, appearance, weight and sound characteristics may occur between individual instruments.
Such variations are inherent to handcrafted production, provided the product remains consistent with its advertised characteristics and contractual description.
These provisions do not affect the Buyer's statutory rights concerning defective or nonconforming products.
4. PRICES AND PAYMENT
Product prices are generally displayed in United States dollars (USD).
The applicable product prices, shipping charges and any additional amounts collected by the Seller are presented before the Buyer confirms payment.
Payment may be completed using the payment methods available at checkout.
The order becomes binding in accordance with the applicable checkout process and confirmation requirements.
Any currency conversion charges or additional fees imposed independently by the Buyer's bank or card issuer are subject to that institution's terms.
No additional charges will be imposed by the Seller without the Buyer's legally required consent.
5. PRODUCTION AND ORDER PREPARATION
Some Leon Cymbals products are available from existing inventory, while others are manufactured or prepared following an order.
The estimated production period for made-to-order products is generally 2–4 weeks, depending on the product and production schedule.
Production time and shipping transit time are separate.
The estimated dispatch or delivery period applicable to an order will be communicated before purchase where required by law.
The Seller will comply with mandatory statutory delivery periods applicable to the transaction.
Where a delay occurs or the applicable delivery obligation cannot be fulfilled, the Seller will inform the Buyer and provide the remedies required by applicable law.
For genuinely personalized Custom Shop products, the production specifications and any specially agreed schedule will be recorded as part of the order.
6. SHIPPING AND DELIVERY
Products are shipped to the delivery address provided by the Buyer.
Available delivery destinations and applicable shipping charges are displayed during checkout.
Estimated transit times may vary depending on the destination, carrier, customs processing and circumstances beyond the Seller's reasonable control.
The Seller remains responsible for delivery obligations and risks to the extent required by applicable consumer protection legislation.
If a shipment arrives visibly damaged, the Buyer is encouraged to photograph the packaging and contact the Seller promptly.
Failure to document visible damage does not automatically eliminate the Buyer's statutory rights.
7. IMPORT DUTIES AND TAXES
International shipments may be subject to import duties, customs charges, local taxes and administrative fees imposed by the destination country.
Whether such amounts are included in the checkout total or payable upon import depends on the delivery terms communicated before the order is placed.
Where the order is shipped under terms that require the Buyer to pay import charges, those charges are the Buyer's responsibility to the extent permitted by applicable law.
Where the Seller expressly offers delivery with duties and taxes paid, the charges included in that arrangement will be borne by the Seller.
The applicable shipping and import terms must be clearly disclosed before the Buyer completes the purchase.
8. RIGHT OF WITHDRAWAL
Where the Buyer qualifies as a consumer and the transaction is subject to legislation granting a statutory right of withdrawal, the Buyer may withdraw from an eligible purchase within 14 days after receiving the product, without providing a reason.
Where required by applicable law, the Buyer may also exercise this right before delivery.

The Buyer is encouraged to include the order number and product details to facilitate processing.
A particular withdrawal form is not mandatory where applicable law permits withdrawal through any clear statement.
The Seller will acknowledge and process the request in accordance with applicable statutory requirements.
9. RETURNS AND REFUNDS
Following a valid exercise of the statutory right of withdrawal, the Buyer must return the relevant product within the period required by applicable law.
Where Turkish distance-selling legislation applies, the Buyer generally has 14 days from the withdrawal notification to send the product back.
The Seller will refund the payments required by applicable law, including eligible original delivery charges.
The refund deadline and the event from which it begins will be determined by the applicable mandatory legislation.
Refunds will ordinarily be issued through the original payment method unless another legally permissible arrangement is agreed.
Return shipping costs will be allocated in accordance with the mandatory consumer rules applicable to the transaction and the information properly disclosed before purchase.
Where Turkish rules apply, the Buyer will not be charged return shipping costs in circumstances where the Seller is legally required to bear them.
For international returns, the Seller will provide reasonable instructions concerning the return address, carrier arrangements and relevant customs documentation.
Any customs refunds or recoveries will depend on the applicable customs procedures.
10. CUSTOM SHOP AND PERSONALIZED PRODUCTS
Leon Cymbals offers custom manufacturing services for customers requesting specific instruments or characteristics.
Products genuinely manufactured according to the Buyer's individual specifications or personal requirements may be exempt from the statutory right of withdrawal where applicable law expressly permits such an exemption.
Examples may include individually specified dimensions, special construction, personalized engraving or other genuinely customer-specific features.
A standard catalog product does not automatically become a personalized product merely because it is manufactured after the order is placed.
Any applicable withdrawal exception will be disclosed before the relevant purchase is completed.
Nothing in this section excludes statutory rights relating to defective, damaged or nonconforming products.
11. DEFECTIVE PRODUCTS AND WARRANTY
The Buyer retains all mandatory legal rights relating to defective or nonconforming products.
Leon Cymbals also provides commercial warranty and after-sales support under the conditions published on its website.
Commercial warranty coverage may vary depending on the product category.
Damage caused by misuse, inappropriate installation, accidental impact or use contrary to the product's intended purpose may fall outside the commercial warranty, subject to mandatory legal protections.
Special product categories, including FX and Stack products, may have additional warranty limitations disclosed before purchase.
Any commercial warranty is supplementary to, and does not replace, the Buyer's mandatory statutory rights.

The Seller will review requests and provide assistance in accordance with applicable legal obligations.
13. PERSONAL DATA
Personal information provided during checkout may be processed for order management, payment processing, production, shipping, customer support and compliance with legal obligations.

14. GOVERNING LAW AND DISPUTES
The Seller is established in Türkiye.
Subject to mandatory consumer protection rules and applicable international private law principles, this Agreement is governed by Turkish law.
This choice of law does not deprive consumers of mandatory protections applicable in their country of habitual residence where those protections cannot lawfully be excluded.
Jurisdiction and available dispute resolution mechanisms will be determined in accordance with applicable mandatory law.
15. AGREEMENT AND ORDER CONFIRMATION
Before placing an order, the Buyer must be provided with the essential product information, total price, applicable shipping terms and legally required pre-contractual information.
The Buyer must be able to access the applicable contractual terms before confirming the purchase.
The Agreement applies to the relevant order once the applicable legal requirements for concluding the distance contract have been satisfied.
The order confirmation and transaction-specific information form part of the contractual documentation.
The Seller will provide the Buyer with the required order confirmation and contractual information in a durable form where mandated by applicable law.

1.2. Alıcı
leoncymbals.com üzerinden ürün satın alan gerçek veya tüzel kişidir.
Alıcı'nın adı, iletişim bilgileri, fatura bilgileri ve teslimat adresi sipariş sırasında kaydedilir ve ilgili siparişin parçasını oluşturur.
Bundan sonra “Alıcı” olarak anılacaktır.
2. SÖZLEŞMENİN KONUSU VE KAPSAMI
İşbu sözleşme, leoncymbals.com üzerinden gerçekleştirilen mesafeli ürün satışlarına ilişkin sipariş, ödeme, üretim, teslimat, cayma, iade ve satış sonrası destek koşullarını düzenler.
Leon Cymbals, el yapımı ziller ile ilgili müzik enstrümanları ve aksesuarları alanında faaliyet gösteren bir markadır.
İnternet sitesi öncelikle uluslararası müşterilere hizmet vermektedir.
Türkiye'deki müşteriler, Satıcı'nın Kıvılcım Müzik bünyesindeki yerel satış kanallarına yönlendirilmektedir.
İşbu sözleşmenin hiçbir hükmü, uygulanması zorunlu tüketici haklarını ortadan kaldırmaz veya sınırlandırmaz.
3. ÜRÜNLER VE SİPARİŞ BİLGİLERİ
Ürünlerin temel özellikleri ilgili ürün sayfalarında belirtilir.
Sipariş onayında satın alınan ürünler, adetleri, fiyatları, teslimat bilgileri ve varsa kararlaştırılmış kişiselleştirme talepleri gösterilir.
Leon Cymbals ürünleri el işçiliğiyle üretilmektedir. Bu nedenle aynı modeldeki ürünler arasında çekiç izleri, yüzey dokusu, görünüm, ağırlık ve ses karakteri bakımından doğal farklılıklar bulunabilir.
Bu farklılıklar, ürünün ilan edilen temel özelliklerine ve sözleşmede kararlaştırılan niteliklerine uygun olması şartıyla el yapımı üretimin doğal özellikleridir.
Bu hüküm, ayıplı veya sözleşmeye aykırı ürünlere ilişkin kanuni hakları etkilemez.
4. FİYATLAR VE ÖDEME
Ürün fiyatları genel olarak Amerikan doları (USD) üzerinden gösterilir.
Ürün bedeli, kargo ücreti ve Satıcı tarafından tahsil edilen diğer tutarlar, ödeme onayından önce Alıcı'ya sunulur.
Ödeme, ödeme ekranında sunulan yöntemlerle yapılır.
Sipariş, ilgili ödeme ve onay sürecine uygulanabilir koşullar çerçevesinde bağlayıcılık kazanır.
Alıcı'nın bankası veya kart kuruluşu tarafından bağımsız olarak uygulanan kur farkları ve işlem ücretleri, ilgili finansal kuruluşun koşullarına tabidir.
Alıcı'nın kanunen gerekli onayı olmadan Satıcı tarafından ilave ücret tahsil edilmez.
5. ÜRETİM VE SİPARİŞ HAZIRLAMA
Leon Cymbals ürünlerinin bir bölümü stoktan gönderilirken bir bölümü sipariş üzerine üretilir veya hazırlanır.
Sipariş üzerine üretilen ürünlerde tahmini üretim süresi, ürünün niteliğine ve üretim programına göre genellikle 2–4 haftadır.
Üretim süresi ile kargo taşıma süresi birbirinden ayrıdır.
Siparişe uygulanacak tahmini gönderim veya teslimat süresi, mevzuatın gerektirdiği hâllerde satın alma öncesinde bildirilir.
Satıcı, ilgili satışa uygulanması zorunlu yasal teslim sürelerine uyar.
Gecikme yaşanması veya teslim yükümlülüğünün yerine getirilememesi durumunda Alıcı bilgilendirilir ve uygulanabilir mevzuatın öngördüğü haklar sağlanır.
Gerçek anlamda kişiselleştirilmiş Custom Shop siparişlerinde ürün özellikleri ve özel olarak kararlaştırılan üretim takvimi sipariş kayıtlarına eklenir.
6. KARGO VE TESLİMAT
Ürünler, Alıcı'nın bildirdiği teslimat adresine gönderilir.
Gönderim yapılabilen ülkeler ve kargo ücretleri ödeme aşamasında gösterilir.
Taşıma süresi; varış ülkesi, kargo firması, gümrük işlemleri ve Satıcı'nın makul kontrolü dışındaki koşullara göre değişebilir.
Satıcı'nın teslimat yükümlülükleri ve taşıma riskine ilişkin sorumluluğu, uygulanması zorunlu tüketici mevzuatına tabidir.
Teslimat sırasında pakette görünür hasar bulunması hâlinde Alıcı'nın fotoğraf çekerek Satıcı'ya bildirimde bulunması tavsiye edilir.
Hasarın belgelenmemiş olması, Alıcı'nın kanuni haklarını kendiliğinden ortadan kaldırmaz.
7. GÜMRÜK VERGİLERİ VE İTHALAT MASRAFLARI
Uluslararası gönderilerde varış ülkesinin mevzuatına göre ithalat vergileri, gümrük ücretleri, yerel vergiler ve idari masraflar doğabilir.
Bu tutarların sipariş bedeline dahil olup olmadığı veya ithalat sırasında ödenip ödenmeyeceği, satın alma öncesinde bildirilen teslimat koşullarına göre belirlenir.
Siparişin teslim şekline göre ithalat masraflarının Alıcı'ya ait olduğu açıkça belirtilmişse, söz konusu masraflar uygulanabilir mevzuatın izin verdiği ölçüde Alıcı tarafından karşılanır.
Satıcı'nın vergileri ve gümrük masraflarını üstlendiği bir teslimat yöntemi açıkça sunulmuşsa, bu kapsamda belirtilen tutarlar Satıcı tarafından karşılanır.
Uygulanacak teslimat ve ithalat koşulları sipariş tamamlanmadan önce açıkça bildirilir.
8. CAYMA HAKKI
Alıcı'nın tüketici sıfatıyla hareket ettiği ve ilgili satışa uygulanabilir mevzuatın cayma hakkı tanıdığı durumlarda, Alıcı uygun ürünleri teslim aldığı tarihten itibaren 14 gün içinde gerekçe göstermeksizin sözleşmeden cayabilir.
Mevzuatın gerektirdiği hâllerde cayma hakkı ürün teslim edilmeden önce de kullanılabilir.

İşlemlerin kolaylaştırılması için sipariş numarası ve ürün bilgilerinin belirtilmesi tavsiye edilir.
Uygulanabilir mevzuatın açık bir cayma beyanını yeterli gördüğü durumlarda özel bir form kullanılması zorunlu değildir.
Satıcı, cayma talebini ilgili mevzuatın gerektirdiği şekilde değerlendirir ve sonuçlandırır.
9. İADELER VE BEDEL İADESİ
Cayma hakkının geçerli şekilde kullanılması hâlinde Alıcı, ürünü uygulanabilir mevzuatta belirtilen süre içerisinde geri göndermekle yükümlüdür.
Türk mesafeli satış mevzuatının uygulandığı durumlarda Alıcı'nın, cayma bildiriminden itibaren genel olarak 14 gün içinde ürünü geri göndermesi gerekir.
Satıcı, uygulanabilir mevzuatın öngördüğü ödemeleri, iadesi gereken ilk teslimat ücretleri dahil olmak üzere geri öder.
Bedel iadesinin süresi ve bu sürenin başlangıcı, ilgili satışa uygulanması zorunlu mevzuata göre belirlenir.
İade, hukuken izin verilen farklı bir yöntem kararlaştırılmadıkça, satın alma sırasında kullanılan ödeme yöntemi üzerinden gerçekleştirilir.
İade kargo masraflarının hangi tarafça karşılanacağı, ilgili satışa uygulanması zorunlu tüketici hükümlerine ve satın alma öncesinde usulüne uygun şekilde yapılan bilgilendirmeye göre belirlenir.
Türk mevzuatının Satıcı'ya iade kargo masraflarını karşılama yükümlülüğü getirdiği durumlarda bu masraflar Alıcı'ya yüklenmez.
Uluslararası iadelerde Satıcı, iade adresi, taşıyıcı düzenlemeleri ve ilgili gümrük belgeleri konusunda makul yönlendirme sağlar.
İthalat sırasında ödenen vergilerin iadesi, ilgili ülkenin gümrük prosedürlerine bağlıdır.
10. CUSTOM SHOP VE KİŞİSELLEŞTİRİLMİŞ ÜRÜNLER
Leon Cymbals, müşterilerin özel talepleri doğrultusunda üretim hizmetleri sunmaktadır.
Alıcı'nın bireysel özellik taleplerine veya kişisel ihtiyaçlarına göre gerçekten özel olarak üretilen ürünler, ilgili mevzuatın açıkça izin verdiği durumlarda cayma hakkı istisnasına tabi olabilir.
Özel ölçüler, özel yapılandırma, kişisel gravür veya standart ürün seçenekleri dışında kalan müşteri talimatları bu kapsamda değerlendirilebilir.
Standart katalog ürünleri, yalnızca siparişten sonra üretildikleri gerekçesiyle otomatik olarak kişiselleştirilmiş ürün sayılmaz.
Uygulanabilecek cayma hakkı istisnaları, sipariş tamamlanmadan önce Alıcı'ya açıklanır.
Bu hüküm, ayıplı, hasarlı veya sözleşmeye aykırı ürünlere ilişkin kanuni hakları ortadan kaldırmaz.
11. AYIPLI ÜRÜNLER VE GARANTİ
Alıcı'nın ayıplı veya sözleşmeye aykırı ürünlere ilişkin zorunlu kanuni hakları saklıdır.
Leon Cymbals ayrıca internet sitesinde yayımlanan koşullar çerçevesinde ticari garanti ve satış sonrası destek sunar.
Ticari garanti kapsamı ürün grubuna göre değişebilir.
Yanlış kullanım, uygunsuz montaj, kazara darbe veya ürünün kullanım amacına aykırı davranışlardan kaynaklanan hasarlar, zorunlu kanuni haklar saklı kalmak kaydıyla, ticari garanti dışında değerlendirilebilir.
FX ve Stack gibi özel ürün gruplarında satın alma öncesinde açıklanan ilave garanti sınırlamaları bulunabilir.
Ticari garanti, Alıcı'nın zorunlu kanuni haklarının yerine geçmez; bu haklara ek olarak sunulur.
12. MÜŞTERİ HİZMETLERİ VE ŞİKÂYETLER
Alıcı, sipariş, teslimat, iade, garanti veya sözleşmeyle ilgili diğer konularda Satıcı'ya aşağıdaki kanallardan ulaşabilir:

Satıcı, talepleri ilgili yasal yükümlülükleri çerçevesinde değerlendirir ve destek sağlar.
13. KİŞİSEL VERİLER
Sipariş sırasında sağlanan kişisel veriler; sipariş yönetimi, ödeme işlemleri, üretim, kargo, müşteri desteği ve yasal yükümlülüklerin yerine getirilmesi amacıyla işlenebilir.
Ayrıntılı bilgiler leoncymbals.com üzerinde yayımlanan Gizlilik Politikası'nda yer almaktadır.
14. UYGULANACAK HUKUK VE UYUŞMAZLIKLAR
Satıcı Türkiye'de yerleşiktir.
Uygulanması zorunlu tüketici koruma hükümleri ve milletlerarası özel hukuk kuralları saklı kalmak kaydıyla, işbu sözleşmeye Türk hukuku uygulanır.
Bu hukuk seçimi, tüketicinin mutat meskeninin bulunduğu ülkede sözleşmeyle bertaraf edilemeyen zorunlu korumalardan yararlanmasını engellemez.
Yetkili yargı mercileri ve başvuru yolları, uygulanabilir zorunlu mevzuata göre belirlenir.
15. SÖZLEŞMENİN KURULMASI VE SİPARİŞ ONAYI
Sipariş verilmeden önce Alıcı'ya ürünün temel özellikleri, toplam fiyatı, teslimat koşulları ve mevzuatın gerektirdiği ön bilgilendirmeler sunulur.
Alıcı, satın alma işlemini onaylamadan önce ilgili sözleşme koşullarına erişebilmelidir.
İşbu sözleşme, mesafeli sözleşmenin kurulmasına ilişkin uygulanabilir yasal koşulların tamamlanmasıyla ilgili sipariş bakımından hüküm doğurur.
Sipariş onayı ve siparişe özgü bilgiler sözleşme belgelerinin tamamlayıcı parçasıdır.
Satıcı, mevzuatın gerektirdiği durumlarda sipariş onayını ve sözleşme bilgilerini Alıcı'ya kalıcı veri saklayıcısı aracılığıyla iletir.
